DİPLOMATİK DOKUNULMAZLIK VE AYRICALIKLARIN KÖTÜYE KULLANILMASI

Günümüzde diplomasi ve konsolosluk memurları uluslararası hukuka göre belirli dokunulmazlık ve ayrıcalıklara sahip bulunmaktadırlar. Fakat bu diplomatların her durumda dokunulmaz olduğu anlamına mı gelmektedir? Diplomatların sahip bulundukları dokunulmazlık ve ayrıcalıkları kötüye kullanmaları, insan hak ve özgürlüklerini ihlâl etmeleri, uyuşturucu madde veya insan ticareti yapmaları, casusluk faaliyetinde bulunmaları veya kabul eden devletin hukuk ve düzenlemelerini ihlâl etmeleri hallerinde de diploma- tik dokunulmazlık geçerli midir? Bu soruna ilişkin yeterli açık hükümler içermeyen ve bugün büyük ölçüde zamanın ruhunun dışında kalmış olan 1961 Viyana Diplomasi İlişkileri Sözleşmesi ve 1963 Viyana Konsolosluk İlişkileri Sözleşmesi ile düzenlenmiş bulunan uluslararası hukukun, kanun önünde eşitlik ve hukukun üstünlüğü evrensel hukuk ilkeleri ile modern gelişmeler ışığında güncellenmesi ve sonuç olarak hiç kimsenin hukukun üstünde olmaması gerekmektedir.

The Abuse of Diplomatic Immunity and Privileges In modern times, diplomatic and consular agents enjoy certain immuni- ties and privileges afforded by the international law. But does this mean they are untouchables? Is diplomatic immunity still acceptable even when they conduct spying, involve drug or human being trafficking, violate human rights and fundamental freedoms, commit a crime under the law of a recei- ving state or abuse diplomatic immunities and privileges in any other man- ner. In this context, the international law mainly provided by the Vienna Convention on Diplomatic Relations 1961 and the Vienna Convention on Consular Relations 1963 has today become obsolete to a certain extent and therefore must be updated in the light of modern developments and the prin- ciples of universal law, notably equality before the law and the rule of law, and consequently no one should be above the law.
