EVALUATING THE SUCCESS OF INTERNATIONAL CRIMINAL TRIBUNAL FOR FORMER YUGOSLAVIA

The “International Criminal Tribunalfor Former Yugoslavia” (ICTY) whichwas established on May 25 1993 due tothe conflicts in the territory of the FormerYugoslavia that reached a size that wouldthreaten international peace and securityhas completed its duties and officiallyended its existence on 31 December 2017.For more than 24 years the ICTY hasundertaken significant work both for itsmandate and for international criminal lawand in this sense it has left a significantlegacy behind. Therefore its importanceboth for the region and for internationalcriminal law has been widely emphasized.On the other hand the ICTY has had tostand to criticism directed to its activitiesand to international criminal law in a moregeneral sense.In this scope, it is evaluated thatevaluating the work of the Tribunal andits success through analysing the abovereferredpraises and criticism bearsimportance.In this framework, in this study, firstlythe aims assigned to the ICTY will bedetermined and subsequently the successof it will be evaluated within the scope ofthese objectives.

Eski Yugoslavya Uluslarası Ceza Mahkemesinin Başarısının Değerlendirilmesi

Eski Yugoslavya Sosyalist Federal Cumhuriyetinin topraklarında yaşanan ve uluslararası barış ve güvenliği tehdit edecek boyutlara ulaşan çatışmalar sebebiyle 25 Mayıs 1993 tarihinde kurulan “Eski Yugoslavya Uluslarası Ceza Mahkemesi” (Mahkeme) faaliyetlerini tamamlayarak 31 Aralık 2017 tarihinde resmen varlığını sona erdirmiştir. Mahkeme faaliyette kaldığı 24 yılı aşkın süre boyunca, hem kendi yetki alanı için hem de daha geniş anlamda uluslararası ceza hukuku için önemli çalışmalara imza atmış ve bu anlamda ardında önemli bir miras bırakmıştır. Bu sebeple Mahkemenin hem bölgesi hem de uluslararası ceza hukuku için önemi sıklıkla vurgulanmıştır. Bununla birlikte; Mahkeme aynı zamanda, uluslararası hukuka yönelen genel eleştiriler ve etkinliği ile ilgili olumsuz değerlendirmelerle de karşılaşmıştır. Bu kapsamda, mahkemenin ortaya koyduğu çalışmaların incelenmesi ile Mahkemeye yönelik eleştiri ve övgülerin incelenerek başarısının değerlendirilmesinin gelecekte bu alanda yapılacak çalışmalar açısından önem arz ettiği değerlendirilmektedir. Bu çerçevede, bu çalışmada öncelikle Mahkemeye tahmil edilen hedefler tespit edilecek ve müteakiben Mahkemenin başarısı bu hedefler kapsamında değerlendirilecektir.
