Bu çalışma İslam’ın yönetim sistemleri Esaslarını ve bu esasların, İslam medeniyeti süresince yönetim sistemlerinin geliştirilmesinde istinbât hükümlerine ve fıkhî kaidelere nasıl katkı yaptığını açıklamayı amaçlamaktadır. Bunun etkisi Osmanlı devletindeki yasama kanunlarının oluşumunda ortaya çıkmaktadır. Osmanlı devletinin ardından gelen Modern devletlerin oluşumunda bu kanunların etkisi devam etmektedir. Usûl hükmünde olan bu esaslarının, şura sistemi ve istinbât kural ve usullerini alma metoduyla Allah’ın şeriatını hükmetmesi, hâkim-mahkûm ilişkilerini düzenlemesi gibi konuların çözümlenmesi ve açıklanmasından sonra, ikisi arasındaki ilişkinin birbirine destek veren ve birbirini tamamlayan tamamlama ve dengeleme ilişkisi olduğu sonucuna varıldı. Dolayısıyla yargı sistemi bununla düzelmekte ve hâkim-mahkûm ilişkilerinde ve devlet işlerinde etkili genel kanuni yasalar ortaya çıkar.

The study attempts to explore the fundamental ruling system in Islam, and how those jurisdiction fundamentals and deduction fundamentals contributed in developing of the ruling system through the Islamic civilization. Its affect appears in the Sharia law formatting during the Ottoman Empire, in order for this lawful legacy to continue for the formation of the modern states, that was inherited from the Ottoman Caliphate. After analyzing and revealing those fundamentals which considered to be fundamental from God law, and regulating the relation between the ruler and the one to be ruled, under the Shira law through taking the deduction fundamentals and principles. We find that the relationship between them as a completion and balancing, where they are interdependence and complete each other. As a result, building of a ruling structure that shows the general effective legal legislation in the state and the relation between the ruler and one to be ruled.
