AB'de sığınma hakkı: Ortak sığınma sistemi oluşturma amacı ve devam eden kısıtlamalar

Özet: Çalışmada ilk olarak, sığınma hakkının temel bir insan hakkı mı yoksa devletlerin e-gemenlik hakkından kaynaklanan bir hak mı olduğu tartışması, teorik çerçeve ve uluslararası belgeler dikkate alınarak yapılacaktır. Sonra, AB 'de ortak bir sığınma sistemi oluşturulması için yapılan çalışmalar, özellikle Maastricht ve Amsterdam Antlaşmaları ile getirilen yenilikler üzerinde durularak incelenecektir. Sığınma hakkına uygulanan 3. güvenli ülke, geçici koruma, sınır güvenlik önlemleri ve kontrol sistemleri gibi kısıtlamalar ayrıntılı olarak ele alınacak ve bu kısıtlamaların sığınmacıların haklarını etkin olarak kullanmalarına engel olduğu vurgulanacaktır. Sonuçta bir değerlendirmenin ardından, üye devletlerin kendi egemenlik alanları, güvenlikleri ve vatandaşlarının refah ve haklarına daha fazla önem verme eğilimleri ve sığınma hakkının üye devletlerin tasarrufunda olmaya devam etmesi gibi nedenlerle, AB 'de etkili bir ortak sığınma sistemi kurmanın mümkün olamadığı belirtilecektir.

The right to seek asylum in the European Union: The purpose of establishing a common asylum and the ongoing restrictions

Abstract: This article, firstly, the status of the right of asylum will be focused on and then the issue of whether this right is a fundamental human right or a right stemming from the States' sovereignty will be discussed in view of the theoretical framework and international documents. After clarifying the status of the right to seek asylum, workings aiming to establish a common asylum policy will be scrutinized, particularly focusing on the innovations created by the Maastricht and Amsterdam Treaties. After this examination, the restrictions imposed on the right to seek asylum such as safe third country rule, temporary protection, border security measures and control systems will be assessed in details and it will be emphasized that these restrictions prevent the refugees to use their rights effectively. In the conclusion part of the study, after making an evaluation of all issues examined in the article, it will be stated that it can not be possible to establish an effective common asylum policy in the EU due to the reasons such as the member states' tendency to grant more importance to their own fields of sovereignty, security and also their own citizens' welfare and rights and the continuation of the right of asylum to be in the possession of the member states.
