TECHNOLOGY TRANSFER BLOCK EXEMPTION REGULATION (240/96) AND GUIDELINES IN TERMS OF HARD CORE AND EXCLUDED RESTRICTIONS

Fikri hakların unsurları, birçok hukuk sistemlerinde rekabet politikalarıbelirlenirken temel alınmıştır. Bu unsurlar, özellikle rekabet hukukuncadüzenlenmektedir. Hem fikri haklar hukuku hem de rekabet hukukunun uygulandığılisans anlaşmaları ise, fikri hakların başkaları tarafından kullanımına izin vererekteknolojinin yayılmasına hizmet eder. Lisans sözleşmelerinin çerçevesini belirleyen enönemli düzenlemeler, Teknoloj i Transf eri Sözleşmeleri Hakkındaki Grup Muaf iyetiTüzüğü(TTBER) ile teknoloji transfer sözleşmelerine ilişkin Rehber İlkelerdir.Bu kapsamda, önemli bir hususun analiz edilmesi gerekir; TTBER ve ilgiliRehber İlkeler uyarınca kara liste (hard core) ve yasak kısıtlamalar (excludedrestriction) açısından rakip ler ve rakip olmayanlar arasında nasıl anlaşmalaryapılır?

Elements of intellectual p rop erty rights are used by several legal systemswithin their comp etition p olicies. In p articular, they are regulated by comp etitionlaw. License agreements, in which comp etition law and intellectual p rop erty laware app lied together, have served to distribute technology by allowing intellectualp rop erty rights to be used by others. The f ramework f or intellectual p rop erty rightslicensing was arranged by the Technology Transf er Block Exemp tion Regulation(240/96)(TTBER) and also Guidelines regarding technology transf er agreements. In this regard, an imp ortant issue should be analyzed; how agreementsbetween comp etitors and those between non-comp etitors are dealt with under theTTBER and Guidelines in terms of hard core and excluded restrictions?In this study, I would like to f ocus on the af orementioned question underTTBER and concerned Guidelines.
