ABD KANUNLAR İHTİLÂFI HUKUKUNA KURAMSAL VE METODOLOJİK BİR BAKIŞ: ÇEŞİTLİ TEORİ VE METOTLAR, II. RESTATEMENT VE SÖZLEŞMEYE UYGULANACAK HUKUK

Bu çalışma, ABD kanunlar ht lâfı hukukunu etk leyen bazı kuramsal ve metodoloj k gel şmeler le II. Restatement'ta sözleşmeye uygulanacak hukuk üzer ne odaklanmıştır. I. Restatement'a karakter st k özell ğ n yansıtan (klâs k s stem olarak da fade ed len) kazanılmış haklar kuramı ncelend kten sonra, klâs k ABD kanunlar ht lâfı hukukuna yönelt len eleşt r ler ve bu alandak çağdaş eğ l mler le II. Restatement üzer nde durulacaktır. Sözleşmeden doğan borç l şk ler ne uygulanacak hukuka l şk n II. Restatement'ta yer alan düzenlemeler n, son dönem kanunlar ht lâfı hukuku kuram ve metodoloj s açısından devr m n tel ğ nde olduğu söylenebilir.

A THEORETICAL AND METHODOLOGICAL OVERVIEW OF THE USA CONFLICT OF LAWS: VARIOUS THEORY AND METHODS, II. RESTATEMENT AND THE LAW TO BE APPLIED TO CONTRACTS

This study has focused on some theoretic and methodological advancements having infl uences on the USA confl ict of laws and applicable law to contract in II. Restatement. After the vested rights theory refl ecting the characteristic features of I. Restatement (which is also called as classical system) is examined, the criticism directed to the USA classical confl ict of laws and contemporary trends in the Ş eld and II. Restatement will be discussed. The regulations in the II. Restatement regarding the governing law of obligation relationships arisen from contracts can be suggested to be revolutionary with regards to the recent confl ict of laws theory and methodology.
