Türkiye'de Finansallaşma ve Hukuk: İstanbul Tahkim Merkezi'nin Kuruluşu

2000'li yıllarda finans sektörünün ekonomi içindeki ağırlığının artması ve finans piyasalarının derinleşmesi, yabancı yatırımcıların artan finansal yatırımlarını güvence altına alacak uluslararası standartlara uyumlu bir hukuki altyapıya duyulan ihtiyacı ortaya çıkarmaktadır. Çalışmada amaçlanan İstanbul'da kurulması hedeflenen tahkim merkezinin Türkiye'de finansallaşma sürecine devletin hukuki müdahale aracı olarak yaratacağı etkilerinin ortaya konmasıdır. Bu çalışmada İstanbul'da bir tahkim merkezinin kurulmasının finans merkezi projesi sürecine katkıları analiz edilecektir. Çalışmada, Türkiye ekonomisinde finansallaşma sürecinin kent ekonomisi üzerindeki etkileri finansallaşma ve hukuk ilişkisi üzerinden ele alınırken, finansallaşma sürecinin Dünya'da yaşanan gelişmeler bağlamında incelenmesi hedeflenmektedir. İstanbul Uluslararası Finans Merkezi Projesi Eylem Planı'nda yer alan tahkim merkezi hedefi finansallaşma ve hukuk ilişkisi bakımından incelenmeyi hak etmektedir. Dünya finans merkezleri ile İstanbul'un karşılaştırılması finansallaşma sürecine hukuk sisteminin uyumunu, hukukun özelleştirilmesi kavramı üzerinden açıklamak bu çalışmanın temel amacını oluşturmaktadır

Financialization and Law in Turkey: The Establishment of Istanbul International Arbitration Center

In 2000's increasing height of financial sector in the economy and financial depth unfolds the need to a legal system that makes guarantee increasing foreign financial investments to the city. In this study, it is aimed to underline the effects of the arbitration center which will be established in Istanbul as a legal instrument of state intervention on financialization process in Turkey. In this study, establishment of an arbitration center in Istanbul will be analyzed such an extend for its contribution to Istanbul Financial Center Project. In the study, it is also aimed to analyze the effects of financialization process on urban economy in terms of the relation between financialization and legal system, and it will also analyzed the developments in the world economy in terms of financialization. It is important to analyze the target of establishing an arbitration center in Istanbul Financial Center Project in terms of financialization and legal system. Comparing Istanbul with other financial centers in the world is necessary to have the knowledge of the harmonization of judicial system with financialization and the main aim of this study is to explain the whole process conceptualizing the process of "privatilizing of legal systems"
