SİLAHLI ÇATIŞMA ORTAMLARINDA CİNSEL ŞİDDETE UĞRAYAN KIZ ÇOCUK VE KADINLARIN CENEVRE SÖZLEŞMELERİ BAĞLAMINDA KÜRTAJ HAKKI

Silâhlı çatışma ortamlarında cinsel sağlık ve üreme sağlığı hizmetleri, insani yardım alanında daha erişilebilir hale gelmiş olsa da, güvenli kürtaj hizmetleri hala nadiren sağlanmakta ve cinsel şiddet mağdurlarına sağlanan bakım yetersiz kalmaktadır. Bugün, çatışma ortamlarında cinsel şiddet sonucu hamile kalanlar da dahil olmak üzere kız çocuklar ve kadınlar, yıkıcı sonuçları olan kürtajlardan genel olarak mahrum bırakılmaktadır. Silâhlı çatışmalarda güvenli kürtaj bakımına erişimin bu eksikliğinin birçok nedeni bulunmaktadır. İlk olarak, güvenli kürtaj bakımına erişim, kürtajın yasal statüsüne bağlıdır. Bunun yanında, yasal kısıtlamaların yanı sıra, silâhlı çatışma durumlarında güvenli kürtaj bakımının önünde bir dizi başka engeller de bulunabilir. Güvenli kürtaj bakımına erişimin insani boyutu, yasal sorundandaha büyük olup en az yasal engeller kadar önemlidir. Kız çocukları ve kadınları cinsel şiddet sonucu oluşan bir gebelik sürecine zorlamak veya bu kişilere kürtajın sağlanmasının reddedilmesi, insani muamele hakkını ve zalimane ve insanlık dışı muameleye maruz kalmama hakkını ihlal eder.

The Right of Girls and Women Who Have Been Sexually Assaulted in Armed Conflict in the Context of Geneva Conventions

While sexual and reproductive health services have become more accessible in the humanitarian field in times of armed conflict, safe abortion services are still rarely provided and the care provided to victims of sexual assault remains inadequate. Today, girls and women, including those who become pregnant as a result of sexual assault in conflict settings, are routinely denied abortions with devastating consequences. There are many reasons for this lack of access to safe abortion care in armed conflict. First, access to safe abortion care depends on the legal status of abortion. In addition to legal restrictions, there may be a number of other barriers to safe abortion care in situations of armed conflict. The humanitarian dimension of access to safe abortion care is greater than the legal challenge and just as important as the legal barriers. Forcing girls and women into a pregnancy resulting from sexual assault or refusing to grant them an abortion violates the right to humane treatment and the right not to be subjected to cruel and inhumane treatment.
