İSLAM AHLAKI OLARAK İSLAM HUKUKU

Yazar, İslam Hukuku"nun İslam ahlakı için İslam Teolojisi veya felsefesinden çok daha fazla temel oluşturduğunu öne sürdükten sonra, hukukla (ve dolayısıyla ahlakla) ilişkili üç temel terimi analiz etmektedir: fıkıh, şer" ve şeriat. Daha sonra hukukî/ahlakî anlayışın (fıkıh) dört kaynağını (usul) izah etmekte, herhangi bir meselede bir yargıya (hüküm) varmayı sağlayan yöntemi açıklamakta, bu gibi hükümlerin tasnif kurallarını tartışmakta ve (makaleyi) İslam hukuku ve bilgi ahlakının davranışla ilişkisi üzerine bir takım yorumlarla neticelendirmektedir.

Islamic Law As Islamic Ethics

After arguing that Islamic law is more basic to Islamic ethics than is either Islamictheology or philosophy, the author analyzes three basic terms associatedwith law (and therefore ethics): fiqh, shar and sharVah. He then sets forth thefour roots (usul) of legal/ethical understanding (fiqh), describes the manner inwhich a judgment (hukm) is reached in any particular case, discusses the taxonomyof such judgments, and concludes with some comments on the rela- tionwithin Islamic law and ethics of knowledge to action.
