ULUSLARARASI ÖRGÜTLERİN ULUSLARARASI SORUMLULUĞU VE BM TASLAK SÖZLEŞMESİ

Uluslararası hukuk kurallarının oluşturulmasında ve geliştirilmesinde önemli yeri olan ve kurucu anlaşmaları itibariyle belirli amaçları gerçekleştirmek için kurulan uluslararası örgütler, faaliyetlerini yürütürken zarar verici hukuka aykırı eylemler işleyebilirler. Örgütün işlediği iddia edilen haksız eylemden hangi koşullarda sorumlu tutulacağı ve sorumluluğun nasıl işletileceği önem arz etmektedir. Bu itibarla Birleşmiş Milletler Uluslararası Hukuk Komisyonu, bu konuda taslak bir sözleşme örneği hazırlamıştır. Örgüt üyesi devletlerin sorumluluğuna da yer vermiş olan ve henüz devletlerin onayından geçmemiş bu taslakla ilgili inceleme yapan bu çalışma, taslak metni kritik ettikten sonra uluslararası örgütlerin sorumluluğunun nasıl işletileceğiyle ilgili sorunlara değinmiş, bu konudaki gelişmelere yer vermiştir. Örgüt üyesi devletin/devletlerin hangi koşullarda sorumlu tutulacağını ele alan çalışma, ulusal ve uluslararası yargı organlarının kararlarını incelemiş olup, bu kararlar bağlamında uluslararası örgütün sorumluluğunun işletilmesiyle ilgili karşılaşılan sorunları değerlendirmiştir.

INTERNATIONAL RESPONSIBILITY OF INTERNATIONAL ORGANIZATIONS AND THE UN DRAFT ARTICLES

International organizations having been established to achieve certain purposes in accordance with their constituent instruments and playing a crucial role in the legislation and improvement of the rules of international law may commit wrongful acts while carrying out their activities. In this respect, in what circumstances the organization will be held responsible for the alleged wrongful actions and how the responsibility will be exercised have importance. In this regard, the United Nations International Law Commission prepared draft articles on the responsibility for internationally wrongful acts. This study has examined and criticized these draft articles on the responsibility of the member states of the organization who have not ratified these articles yet. While dealing the problems relating to specifying the content of the responsibility, definition of the circumstances and the operation of the responsibility of the international organizations, this study scrutinizes the developments with regard to this subject. Touching on the responsibility of member States and the conditions, this study examines the resolutions of internal and international courts and evaluates the problems encountered in the exercise of the responsibility of the international organization in the context of these resolutions.
