Mortgage Kredilerinde Erken Ödeme Ücreti (Cezası)

Türk Borçlar Kanunu’nun 80. Maddesinde öngörülen genel kural, belirli vadeye bağlanmış borçların erken ödenemeyeceği şeklindedir. Tüketicinin Korunması Hakkında Kanun’a göre ise, mortgage kredilerinde tüketici erken ödeme hakkına sahiptir (m.10/b). Buna gore tüketici bir veya daha fazla taksiti erken ödemede bulunabilir. Böyle bir durumda, alacaklı Ş nansman kuruluşu işlememiş faiz oranındaindirim yapmak zorundadır. Sabit faizli mortgage kredilerinde sözlşmenin tarafl arı, erken ödeme miktarının %2’sine kadar erken ödeme ücreti ödeneceğini kararlaştırabilirler. Türk sisteminde erken ödeme ücretinin hukuki niteliğinin götürü tazminat olduğu söylenebilir. Alacaklı erken ödeme nedeniyle erken ödeme cezasından daha az zarara uğramışsa, dava yoluyla zararı aşan kısmı geri alabilir. Erken ödeme ücreti alaınabileceğine ilişkin yasal hükümler, Anayasanın eşitlik ve tüketicinin korunmasına ilişkin hükümlerine aykırıdır

Under Turkish Obligation Code art.80 Ş xed term loan can’t be paid prematurely. But Consumer Protection Act grants the early repayment right to mortgagor (Art 10/B). According to this, mortgagor can be made prepayment one or more installment. At this situation, the mortgage lender should reduce the interest which didn’t run from the all loan. In the Ş xed interest mortgages, parties to the loan agreement may determine the prepayment penalty up to 2% of sum of early repayment. Legal nature of the prepayment fee in the Turkish system is a lump compensation. If because of early repayment a mortgage lender suffers a loss lesser than the prepayment fee, the mortgagor may get the surplus by the means of civil case. The provisions which regulated prepayment penalty are against the provisions of Constitution concerning equality and consumer protection
