İnsan Hakları ve Karşı Hegemonya

Tarihsel olarak insan hakları söyleminin ve hak taleplerinin sosyal hareketler tarafından kullanılması, güç ilişkileri ve yapılarının sorgulanması açısından önemli bir rol oynamıştır. İnsan hakları söyleminin kullanılması politik, ekonomik ve sosyal taleplerin hak talebi şeklinde ifadelendirilmesidir ve sadece araçsal olmayıp, alternatif değerler, normlar ve hayat şekillerini meşrulaştırmak için operasyonel önem, yani Gramsci’nin terminolojisiyle hegemonya-karşıtı özellik taşır. Bu çalışmanın amacı, güncel olarak küresel hegemonya ve adaletsizliğin bir parçası ve destekleyicisi olarak kullanılan insan hakları söyleminin karşı-hegemonya açısından işlevsel özü, küresel adaletsizliğe karşı direnişin örgütlenmesine ve sözünün güçlenmesine katkı sağlayacak güncel potansiyelinin sorgulanmasıdır. Makalede, Türkiye’deki emek örgütlerinin uluslararası insan hakları sözleşmelerinden ve bunların uygulanmasının denetlenmesi amacıyla kurulmuş uluslararası mekanizmalardan bir direniş aracı olarak yararlanıp yararlanmadığı sorusuna, son dönemde gündemde yer etmiş Novamed ve Desa direnişleri örnekleri üzerinden yanıt aranmaktadır

Human Rights and Counter-Hegemony

Historically, the use of the human rights discourse and the human rights claims by the social movements played an important role for challenging the power relations and structures. The use of the human rights discourse is the expression of the political, economical and social demands in the form of claims for rights and is not merely instrumental but bears an operational importance, in Gramscian terms “counter-monic” feature, for legitimizing alternative values, norms and life styles. The aim of this article is to study the current counter-hegemonic substance and the potential of the human rights discourse for organizing and strengthening the resistance against the global injustice, bearing in mind that this discourse is currently serving as an instrument for developing the global hegemony and injustice. The article discuss whether the workers’ organizations in Turkey are making use of the international human rights conventions and the procedures put in place for monitoring the compliance to these conventions, through the recent case studies of Novamed and Desa struggles.
