Birleşmiş Milletler ve Uluslararası Ceza Mahkemesi Arasındaki İlişki

Bu çalışmada, Birleşmiş Milletler ve özellikle de barış ve güvenlik konusunda oynadığı önemli rolden dolayı Birleşmiş Milletler organlarından biri olan Güvenlik Konseyi ile Uluslararası Ceza Mahkemesi arasındaki ilişkinin hukuki niteliğinin belirlenmesi amaçlanmıştır. Bu kapsamda Uluslararası Ceza Mahkemesi kurucu antlaşması olan Roma Statüsü’nde yer alan birtakım düzenlemeler incelenmiştir. Söz konusu düzenlemelerin Güvenlik Konseyi’nin aldığı bazı kararlar ile nasıl uygulandığı karşılaştırılarak, iki kurumun aslında iş birliği ilişkisi halinde hareket ettiği ancak pratikte alınan bazı kararlar ile bu iş birliği ilişkisinin zedelenebildiği değerlendirmesi yapılmıştır.

THE RELATIONSHIP BETWEEN UNITED NATIONS AND INTERNATIONAL CRIMINAL COURT

In this study, it is aimed to determine the legal nature of the relationship between the United Nations and Security Council, which is one of the United Nations organs and it plays important role in upholding peace and security, and the International Criminal Court. In this context, some articles in the Rome Statute which is the founding treaty of the International Criminal Court are examined. It is evaluated that two institutions actually act in a cooperative relationship when compared to the implementation of these articles with some of the decisions taken by the Security Council, but this cooperation relationship could be damaged by some decisions taken in practice.
