Düzenleyici Etki Analizi: Analiz Süreci ve Uygulama

Modern devletin, rekabet edebilir bir ekonominin ve çağdaş bir kamu yönetiminin kurulması, düzenlemelerin kalitesinin artırılmasına bağlıdır. Düzenleyici etki analizi, iyi düzenleme yapma çalışmalarının en önemli aracıdır. Düzenleyici etki analizi; iş dünyası, kamu yönetimi, küçük ölçekli işler, bu işleri yapan küçük firmalar, sosyal refah ve kâr amacı gütmeyen organizasyonlar üzerine oluşturul­maya çalışılan düzenleyici politikaların etkilerinin önceden kabaca ölçülmesi için mali-yet-fayda analizi yapılmasıdır. Analiz, yeni politikaların etkilerinin belirlenmesi ve sayı-sallaştırılması için geliştirilen bir araçtır. Özünde analiz, kapsamlı ve sistematik bilgi toplanması vasıtasıyla karar oluşturmaya etki yapan faktörlerin netleştirilmesidir. Mevzuat Hazırlama Usul ve Esasları Hakkında Yönetmeliğin yürürlüğe girmesiyle bir­likte düzenleyici etki analizinin Türk kamu yönetiminde uygulanmasının yolu açılmıştır.

Regulatory Impact Analysis: Analysis Procedure and Implementation

The article claims that, establishing a modern state, building a competitive economy and modern public administration depends to be improve the quality of regulations. Regulatory impact analysis is a tool for regulatory reform that improves quality of regulations. A Regulatory impact analysis is a tool which informs policy decisions. It is an assessment of the impact of policy options in terms of the costs, benefits and risks of a proposal. Regulatory impact analysis includes a range of methods that can be used flexibly to measure the impact of proposed regulatory policies on social welfare or on selected target populations such as small businesses, companies, non-profit organizations and public administration. The aim of impact analysis is to enhance the empirical basis of political decisions. Another important aim of regulatory impact analysis is to make the regulatory process more transparent and accountable. By-law on procedure and principles regarding regulations has been promulgated in Turkey and regulatory impact analysis will be implemented starting on February 17, 2007.
