AVRUPA BİRLİĞİ YARGI DÜZENİNDE İHLAL DAVASI: POLONYA ÖRNEĞİ EKSENİNDE BİR İNCELEME

İhlal davası Avrupa Birliği yargı düzenine özgü olan ve üye devletleri Birlik hukukuna bağlı kılmayı amaçlayan uluslararası hukukta benzeri olmayan bir prosedürdür. Üye devletlerin andlaşmalardan doğan yükümlülüklerini ihlal etmesi halinde Komisyon ve üye devletler tarafından harekete geçirilen bu mekanizma Birlik hukukuna saygının ve ulusal sistemlerde Birlik hukukunun yeknesak bir şekilde uygulanması için çok önemli bir işlevi yerine getirmektedir. Özellikle Birlik değerlerine her zamankinden daha fazla ihtiyaç duyulduğu ve bu değerlere sıklıkla vurgu yapıldığı son zamanlarda bu dava çeşidi de Birlik değerlerinin korunmasında gittikçe artan bir öneme sahip olmaktadır. Çalışmamızda bu önemine binaen ihlal davası ayrıntılı bir şekilde incelenmiş ve en önemli AB değerlerinden biri olan hukukun üstünlüğü ve yargı bağımsızlığı ilkelerinin detaylı bir şekilde incelendiği ihlal davasının en güncel örneklerinden birisini teşkil eden Polonya örneği ele alınmıştır.

INFRINGMENT CASE IN EUROPEAN UNION JURISDICTION: AN EXAMINATION ON THE LINE OF THE POLISH CASE

Infringement case is a unique procedure in international law, which is specific to the European Union jurisdiction andaims to subordinate member states to Union law. This mechanism, which is activated by the Commission and themember states in case the member states violate their obligations arising from treaties, performs a very importantfunction for the uniform application of Union law in national systems and Union law. Especially recently, when Unionvalues are needed more than ever and these values are frequently emphasized, this type of case has becomeincreasingly important in protecting Union values. In our study, infringement case was examined in detail based onthis importance and Polish example, which is one of the most recent examples of the infringment case, in which theprinciples of the rule of law and judicial independence, one of the most important EU values, are examined in detail.
