Bir Olgu Üzerinden Çocuk Yapma Yeteneği Kaybının Adli Tıp Açısından Değerlendirilmesi

Vücut dokunulmazlığının ihlali halinde ortaya çıkan zararlar ile ilgili olarak Türk Ceza Kanunu'nda [TCK] yeralan kavramlardan biri de çocuk yapma yeteneğinin kaybolmasıdır. Hukuk kaynaklarına göre üremeye yardımcı organlarda yaralanma sonucunda kişinin kalıcı olarak çocuk yapamaz hale gelmesi olarak tanımlanmaktadır. Hukuki bakımdan, kişide yaralanma sonrasında meydana gelen infertilitenin mi, yoksa sterilitenin mi kanun kapsamında değerlendirileceği konusunda farklı yorumlar bulunmaktadır. Bu durum adli değerlendirmede zorluklara neden olmaktadır. Bu çalışmada batında ve testiste av tüfeği yaralanmasına bağlı olarak ince bağırsak perforasyonu, sağ testis hasarı gelişen ve çocuk yapma yeteneğinin kaybolup kaybolmadığı konusunda adli rapor düzenlenmesi istenen olgu sunulmuştur. Olguda travmaya sekonder infertilite saptanmış ve tıbbi durumuna göre ancak yardımcı üreme tekniklerinden biri ile çocuk sahibi olabileceği şeklinde adli değerlendirme yapılmıştır. Bu olgu sunumu ile çocuk yapma yeteneğinin kaybolması kavramının adli tıbbi yönden değerlendirilmesi amaçlanmıştır.

Evaluation of Losing the Ability to Have Children Over Case in Terms of Forensic Medicine

One of the concepts in Turkish Penal Code [TPC] regarding damages that occur in case of violation of the immunity of the body is losing the ability to have children. According to legal sources, losing the ability to have children is described as person that loses the ability to have children permanently as result of an injury in organs that are assisting productivity. |n the legal sense, there are different interpretations regarding either infertility caused by an injury or sterility should be considered under the law. This causes difficulties in judicial reviews. In this study, case that needs forensic report regarding whether he has lost the ability to have children as result of damage in the right testicle and intestinal perforation due to shotgun injury has been presented. In the case, infertility that is secondary to trauma is identified and it has been suggested that the subject can have children with one of the assisted reproductive technologies. In this case report, it has been aimed to evaluate the concept of losing the ability to have children in terms of forensic medicine.
