ULUSLARARASI HUKUK VE AB HUKUKU DUZENLEMELERI KAPSAMINDA OTANAZI VE BELC IKA ORNEGINDEOTANAZIYE ILISKIN YASAL DUZENLEMELER*

Hukuk ve Tıbbi Bilimler açısından son derece önemli bir konu olan "Ötanazi" ve uygulamaları Belçika örneğinde yasal düzenleme ile olanaklı hale getirilmiştir. Bu çalışmada öncelikli olarak; Avrupa Konseyi (AK) Düzenlemeleri, "Oviedo Konvansiyonu" ve ayrıca "Hasta Hakları" kapsamlarında, Ötanazinin hukuksal nitelemesi ve tespiti yapılmıştır. Ayrıca; Avrupa Birliği (AB) mevzuatında ve uluslararası hukuk açısından durumun ne olduğu da çalışma içerisinde kısaca incelenmiştir. Çalışma kapsamında, 2002 yılında Belçika'da yürürlüğe giren Ötanazi Yasası'ndaki düzenlemeler ve oluşturulan Komisyonun işleyişi değerlendirilmiştir. Bu noktada, Belçika özelinde "Ötanazi" konusunda var olan mevzuat ve uygulamanın yansımaları, Türkiye'de Ötanaziyi değerlendirme için farklı bir bakış açısı sunacaktır.

(EUTHANASIA FROM THE PERSPECTIVE OF INTERNATIONAL - EU LAWS, EUTHANASIA AND PATIENT RIGHTS IN BELGIUM)

"Euthanasia" and its application, which is very important in terms of Law and Medical Sciences, has been legally regulated in the example of the Belgian case. In this study, the legal qualification and determination of Euthanasia has been made within the scope of Council of Europe (EC) Regulations, "Oviedo Convention" and also "Patient Rights". The situation in the European Union (EU) legislation and in terms of international law has also been explored briefly in the study. Within the scope of the study, the regulations in the Euthanasia Law, which was enacted in Belgium in 2002, and the functioning of the created commission are evaluated. At this point, the reflections of legislation and practice on "euthanasia" in Belgium will offer a different perspective for evaluating situation of euthanasia in Turkey.
