ULUSLARARASI UZAY İSTASYONUNA İLİŞKİN ANLAŞMADA PATENT HUKUKU ALANINDAKİ KANUNLAR İHTİLAFI KURALI
Uzay çağının başındaki durumdan farklı olarak, özel kişiler, uzay faaliyetlerinin ticarileşmesiyle, uzayda daha etkin bir rol oynamaktadır. Uzayda değişen bu bağlamın sonuçlarından birisi patent haklarının korunması hususudur. Uzay alanında görülen en önemli iş birliği örneklerinden birisi olan Uluslararası Uzay İstasyonu (UUİ), mikrogravital koşullarda deneylerin yapılmasına olanak vermektedir. Bu noktada ortaya çıkan sorun UUİ’de yapılan veya kullanılan buluşlar dolayısıyla hangi patent hukukunun uygulanacağıdır.
THE RULE OF CONFLICTS OF LAW REGARDING PATENT LAW IN THE INTERNATIONAL SPACE STATION AGREEMENT
In contrast to the beginning of the space age, private entities now play a central role in space operations under the influence of commercialization of space activities. The changing context of space has raised the issue of protecting patent rights. The International Space Station (ISS), one of the most important examples of international cooperation in the space field, allows certain scientific experiments to be carried under micro gravity conditions. The question posed here is: which patent law is applicable to protect an invention made or used on board the ISS?
