ULUSLARARASI GÖÇTE GEÇİCİ KORUMA POLİTİKASININ POLİTİKA TRANSFERİ ÇERÇEVESİNDE KARŞILAŞTIRMALI ANALİZİ: ALMANYA, HOLLANDA VE TÜRKİYE ÖRNEĞİ

Uluslararsı geçici koruma politikasının ortaya çıkış süreci, uygulanan asgarî standartlar ve bunların kapsamı Almanya, Hollanda örnekleri üzerinden analizler yapılarak politika transferi bağlamında incelenmiştir. Çalışma, 2013 yılında çıkarılan 6458 sayılı Yabancılar ve Uluslararası Koruma Kanunu çerçevesinde, özellikle 2011 sonrası Türkiye’ye gelen geçici koruma altındaki Suriyelilerin durumlarını düzenlemek üzere oluşturulan geçici koruma uygulaması politika transferi çerçevesinde ele alınmıştır. Çalışmanın amacı; Türkiye’nin uygulamakta olduğu geçici koruma politikasının hangi ülkeden esinlenilerek transfer edildiğini ve politika transferi derecelerinden olan “kopyalama”, “adaptasyon”, “melezleştirme”, “sentez” ve “esinlenme” durumlarından hangisinin uygulandığını anlamaktır. Çalışma ile Avrupa’daki geçici koruma politikalarının örnek uygulamaları (Almanya, Hollanda ve Türkiye) incelenecek olup, politikaların benzerlikleri ve asgarî standartları karşılaştırmalı analiz yöntemi ile ortaya çıkarılacaktır. Çalışma verileri literatür taraması, dökümantasyon/metin incelemesi ile toplanırken veri analizi karşılaştırma yöntemi ile yapılmıştır. Bu çalışma, alanında akademik araştırmaların az ve yetersiz olması nedeniyle gelecekteki araştırmalara rehberlik ve kaynaklık etmesi açısından önemlidir. Araştırmanın çıktılarına göre; Türkiye’deki geçici koruma politikasının Duldung ve TROO’dan etkilenmiş bir politika olduğu ve politika transferi derecelerinden olan esinlenme ve öykünme ile melez (karma) bir yapıda olduğu karşılaştırmalı yöntemler ile ortaya çıkmıştır. Bu çerçevede bu uygulamanın, nereden, nasıl alınarak Türkiye’de uygulanmaya başlanmış olduğu analiz edilirken, gelecekte yeni bölgelere transfer edilmesi ve geliştirilmesi konusunda bir adım atılmış olacaktır.

COMPARATIVE ANALYSIS OF TEMPORARY PROTECTION POLICY IN INTERNATIONAL MIGRATION WITHIN THE FRAMEWORK OF POLICY TRANSFER: THE CASE OF GERMANY, NETHERLANDS AND TURKEY

The process of the emergence of the international temporary protection policy, the minimum standards applied and their scope have been analyzed through the examples of Germany, the Netherlands and examined in the context of policy transfer. The study was discussed within the framework of the Law on Foreigners and International Protection No. 6458 issued in 2013, in particular within the framework of the policy transfer on the practice of temporary protection created to regulate the situation of Syrians under temporary protection who came to Turkey after 2011. The aim of the study is to understand which country the temporary protection policy implemented by Turkey was inspired by, and which of the policy transfer degrees "copying", "adaptation", "hybridization", "synthesis" and "inspiration" was applied. With the study, the sample applications of temporary protection policies in Europe (Germany, the Netherlands and Turkey) and the similarities and minimum standards of the policies will be revealed by comparative analysis method. The study data were collected by literature review, documentation/text review, and data analysis was performed by comparison method. This study is important in terms of providing guidance and resources for future research due to the fact that academic research in its field is scarce and insufficient. According to the results of the research ,it has been revealed by comparative methods that the temporary protection policy in Turkey is a policy influenced by Duldung and TROO and has a hybrid (mixed) structure with inspiration and emulation from the degrees of policy transfer. In this framework, while analyzing where and how this application was taken and started to be implemented in Turkey, a step will be taken in terms of transferring it to new regions and developing it in the future.
