İnsansız Hava Aracı (İHA) Sistemlerinin Hava Hukuku Bakımından İncelenmesi

İlerleyen teknolojik gelişmelere paralel olarak İnsansız Hava Aracı (İHA) sistemlerinin kullanım sahası her geçen gün artmaktadır. Sadece savunma sektöründe değil sivil alanda da İHA kullanımına olan ilgi ve talep çoğalmıştır. Ancak yapısal olarak insanlı hava araçlarından farklı olmaları sebebiyle İHA'ların kullanımında çeşitli problemlerle karşılaşılmaktadır. Sonuç olarak İHA sistemlerinin hukuki bir zeminde kullanımına yönelik tartışmalar doğmaya başlamış ve hukuki açıdan bir sorunsalın varlığı ortaya çıkmıştır. Bu bağlamda makalede, İHA'lara ilişkin henüz tam olarak oluşmamış olan kapsayıcı hukuki düzenlemelerin bir an önce sonuçlandırılmasına ihtiyaç olduğu savunulmaktadır. Çalışmanın amacı sivil maksatlı İHA kullanımı tartışmalarını hukuki bağlamda irdelemektir. Bunun için öncelikle İHA sisteminin ne olduğundan bahsedilerek İHA kullanımının hukuki sorunsalı tartışılacaktır. Akabinde uluslararası ve ulusal hukuki düzenlemelerin kapsamı incelenecek ve son olarak da sınırlı ölçekte sivil İHA kullanımına yönelik uygulanabilirliği olası düzenleyici bir konsept önerisinde bulunulacaktır

Analyzing the Unmanned Aircraft Systems (UAS) under the Aviation Law

Due to the technological developments, the area of the UAS usage has been proliferating on each passing day. Attention to all types of the UAS has prevailed dramatically. Moreover, technological developments have paved the way to increase the requests to use the UAS not only in the defense sector but also in civilian areas as well. However, there are some challenges for the UAS use unlike the manned aircrafts because of structural differences. In conclusion, arguments on the legal use of the UAS have arisen. Regarding to this paper argues that there is an urgent need to conclude the inclusive legal arrangements that have not been formed yet. The aim of this paper is to examine the debates of civilian usage of UAS in legal context. Therefore, it first talks about what the UAS is and general legal problematic fields of the UAS use. Afterwards, it will review the international and national laws concerning with the UAS. And fınally it will suggest a regulatory concept which could be practiced with regards to the limited civilian UAS use
