HUKUKUN KÜLTÜRLE İMTİHANI

Son yıllarda hukuk incelemelerinin gözde kavramlarından biri haline gelen kültürün hukuk ile ilişkisi incelemeye değer bir literatür oluşturmaktadır. Kültür kavramının geçirdiği dönüşümler hukuk ile ilişkisinde birebir etkili olmuş, kültür kavramına ilişkin açıklamalar değiştikçe hukukun toplumsal gerçekliğin bir parçası olan kültüre bakışı da bundan etkilenmiştir. Bu çalışmada, sosyal bilimlerde kültür kavramının geçirdiği dönüşümün politik niteliği ile hukuk ve kültür ilişkisinin görünümleri ele alınmaya çalışılmıştır.

Laws Ordeal with Culture

The relationship between law and culture -which is one of the favorite concepts in last years- constitutes a valuble literature. The tranformation of the concept of culture is refected to the relationship between law and culture, when the explanation of culture concept changes, the perspective of law about culture that is a part of social reality changes. In this study, it has been tried to research the political character of transformation that the concept of culture has got through and the forms of the relationship between law and culture.
