2011 tarihli 6102 sayılı Türk Ticaret Kanunu!nda müşterek avarya bahsi 1272- 1285. maddeler arasında düzenlenmiştir. Müşterek avarya, ortak bir deniz yolculuğuna çıkan gemi ve yükü ortak bir tehlikeden korumak için bilerek ve isteyerek yapılan olağanüstü masraf ve fedakarlıkların, gemi ve yükün tamamen veya kısmen kurtulmuş olmaları halinde, korunan değerlerle orantılı olarak yüklenilmesi olarak tanımlanabilir. Deniz ticaretinde bu paylaşıma “dispeç” adı verilmektedir. Bu çalışmada, 6102 sayılı Türk Ticaret Kanunu ile müşterek avarya bahsinde yapılan değişikliklerden bahsedile- cektir.

The subj ect of General average is regulated between the articles 1275-1285 in the Turkish Commercial Code nr.6102. General average can be def ined as the undertake of the cost and the sacrif ice, which were made knowingly and willingly in a p roportional way in order to p rotect the ship and the shipload of a common voyage f rom a common danger in the case, where the ship and the shipload is wholly or partially saved. In terms of maritime trade this burden sharing is known as “despatch ”. In this article the amendments made by the Turkish Commercial Code nr.6102 on the matter of general average will be mentioned.
