Thanks to registration, novel andindustrially applicable inventions withinventive step, and the novel andindustrially applicable utility models thatlack the inventive step are protectedagainst unlawful users. Verification andassessment of the consequences of theinfringement of patents and utility modelrights requires a high level of technicaland legal expertise. In this article, theissue of infringement of patent and utilitymodel rights is examined in the light offundamental principles and especiallythe practice, and the scope of the rightsconferred by patents and utility models,as well as verification of infringementare discussed with reference to practice.The relevant provisions of the latestact on industrial property rights onpatents are compared with the provisionsof the preceding legislation, Decree Law551 that also pertained to patents. Therelevant provisions of the latest Actdated 10.01.2017 on Industrial Propertyare compared with the provisions of theprevious legislation, Decree Law 551 onpatents.

Patent ve faydalı model haklarına tecavüzün belirlenmesi ve sonuçlarının değerlendirilmesi ise değerli bir teknik ve hukuki uzmanlık gerektirmektedir. Bu çalışmada, patent ve faydalı modele tecavüz konusu ele alınmakta, temel ilkeler ve özellikle uygulama boyutu üzerinde durulmaktadır. Ayrıca, patent ve faydalı modelden doğan hakkın kapsamı ve tecavüzün tespiti konusundaki uygulama da ele alınmaktadır. 10.01.2017 Tarihinde yürürlüğe giren Sınai Mülkiyet Kanununun konuyla ilgili hükümleri de 551 sayılı PatKHK kapsamındaki kurallarla karşılaştırılmaktadır.
