JASTA: TERÖRLE MÜCADELEDE YENİ BİR AŞAMA MI, YOKSA POLİTİK BİR OYLAMA MI?

Bu çalışma Amerikan Terörizmin Sponsorlarına Karşı Adalet Yasası’nın (JASTA)[2] ulusal ve uluslararası düzeydeki muhtemel sonuçlarını göstermeyi amaçlamaktadır. Benzer şekilde yeni yasanın temel hukuk ilkeleri, uluslararası ilişkiler ve toplumdaki etkisine yönelik tepkiler ele alınmıştır. Amerika Birleşik Devletleri’nin sınır ötesi varlığı egemenlik dokunulmazlığı ilkesine yapılan yasa değişiklikleri kapsamında tartışılmıştır. Suudi Arabistan’ın yasaya karşı gösterdiği tavır bazı diğer ülkelerin endişe açıklamalarıyla beraber değerlendirilmiştir. JASTA Kanunu’nun A.B.D.’de yaşayan Müslümanlarının karşılaşabileceği sosyal etkileri çalışma sonunda yer almıştır.

JASTA: NEW COUNTER-TERRORISM OR A POLITICAL VOTE?

This paper aims to show the possible consequences of JASTA in national and international level. Similarly, it analyzes the reactions about the basic law principles, the international relations and the society. U.S.’s international presence is discussed in accordance with the new amendments to the foreign sovereign immunity principle. Saudi Arabia’s standing against the bill is mentioned along with the concern of some other countries. JASTA’s social impacts that American Muslims would face are tried to be described.
