İNGİLTERE’DEN TÜRKİYE’YE YAPILACAK ADLİ TEBLİGATIN HUKUKİ REJİMİ

Bu çalışmada İngiltere’den Türkiye’ye adli belgelerin tebliğ edilmesine ilişkin öngörülen yollar, Hukuki ve Ticari Konularda Adli ve Gayri Adli Belgelerin Yabancı Memleketlerde Tebliğine Dair Lahey Sözleşmesi, Türkiye ile İngiltere Arasında 28.11.1931 Tarihinde İmzalanmış ve 28.6.1932 Tarih ve 2045 Sayılı Kanunla Onaylanmış 13.7.1933 Tarihinde Yürürlüğe Giren Mün’akit Müzahereti Adliye Mukavelenamesi ve iç hukukta yer alan Türkiye sınırları içerisinde meri olan Tebligat Kanunu hükümleri (m. 26) dikkate alınarak açıklanmıştır.

REGULATIONS ON SERVİCE OF JUDICIAL DOCUMENTS FROM ENGLAND TO TURKEY

In this paper, the way of service of judicial documents from England to Turkey has been analyzed. In this term, rules of the Convention of 15 November 1965 on the Service Abroad of Judicial and Extrajudicial Documents in Civil or Commercial Matters and bilateral agreement between Turkey and UK on Legal Assistance dated 28.11.1931, and also rules of Turkish Service Code (Nr. 7201) have been examined.
