Bu çalışma hususi mevzulardan olan şehadet ve yargıda kadının ehliyeti meselesini ele almaktadır. Bu da suçlar, hadler ve öldürme konularını kapsamaktadır. Konu ile ilgili hadisler, fıkhi görüşler ve çeşitli rivayetler bir araya getirilerek bunlardan kadının şehadeti ve yargılanması esas alınarak bu rivayet ve görüşler değerlendirilmiştir. Bu hususta ehliyete arız bir durumun olup olmaması ya da delilin olması durumunda ehliyetin yokluğu, bunların yanında fıkıhçıların nezdinde şehadet ve yargılama arasında bağlayıcılığın müddeti gibi konular ele alınmıştır. Bu konular hakkında açık ve sahih olarak Hz. Peygamber’den herhangi bir haberin gelmediği tespit edilmiştir. Zikrettiğimiz haberlerin bize en uzağı tabiinden gelen mevkuf haberlerdir. Öte yandan bu çalışmada kadının şehadetinin kabul edildiği tespit edilmiştir. Bu durum şehadetin hadlerdeki iki durum olan iki kadının şehadetinin bir erkeğin şehadetine eşit olması ve şehadetin mutlak olarak erkekten bağımsız olmaması hususları hariç diğer bütün çeşitlerini kapsamaktadır. Yine bu hususta Kur’an delilleri, Tabiun ve alimlerin sözlerinin hepsine bağlı kalmıştır. Yargılama hususuna gelince hadlerdeki durum hariç diğer hususlarda kadının yargılanmasına cevaz verilmiştir

The research highlights the legal capacity of woman in judiciary and testimony. Not in general fields but specifically in the crimes and Punishments field. the method of research is to collect all the traditions of the Prophet Muhammad (PBUH) and his companions that relate to the subject, and the main opinions of jurists of fikih, and then to recognize the authentic tradition from the falls ones, then to deduce the Islamic perception of the subject. The research has revealed that there is no authentic prophetic tradition in exclusion the women form giving any kind of testimony, and all what is in the hands is unauthentic traditions or traditions from the followers of his companions. however, the research has stated two conditions deduced from Quranic verses to accept the testimony. the first is plurality "two women equal one man" the second is to be with one-man testimony at least. The research accepts the judiciary of women in al field except the crimes and Punishments field.
