Bu çalışma, Tokatlı şeyhülislam Kadızâde Mehmed Tâhir Efendi’nin hayatını, eserlerini ve vakıf malların kişilerin mülk malı mukabelesinde değiştirilmesi meselesine dair kaleme aldığı risâlesini araştırmayı hedeflemektedir. Birçok fakihe göre mescit dışındaki vakıf malın, istibdâl şartlarının var olması ve yerine yeni vakıf satın alma koşulu ile para karşılığında satılması yahut, vakfın mülk malla ya da vakıf malla değiştirilmesi işlemine İslam Vakıf Hukukunda istibdâl terimi kullanılır. Kadızâde, istibdâl risalesini Kahire’de şeri mahkeme hakimliği görevini icra ederken kaleme almıştır. Kadızâde, II. Mahmut dönemi bir Osmanlı şeyhülislamıdır. On iki eser kaleme almıştır. Bunlardan birçoğu fıkıh hakkında iken tefsir ve tasavvufa dair çalışmaları da bulunur.

This study aims to investigate the biography of Sheikhulislam of the Ottoman Empire Qādī Dhāda Mahmad Tāhir et-Tokādī and Works of the Qādī Dhāda and investigate the pamphlet written by Qādī Dhāda about change of properties of foundations with properties of individuals. According to the general acceptance, the term istibdāl is used to denote selling of foundation properties except masjîds for money on the conditions of existing of istibdāl conditions and of buying a new property instead of the property of foundation or denote exchanging the properties of foundation with that of another foundation or that of an individual. Qādī Dhāda wrote the pamphlet of istibdāl while he doing as judge of the Sharia court in Cairo. Qādī Dhāda is the Sheikhulislam of the period Mamhud II in the Ottoman Empire. He wrote twelve works. Many of works are about fiqh. There is a work about tafsir and about sufism.
