İslam toplumlarında erken dönemlerden itibaren muamelelerin yazılı sözleşmeler yoluyla kayıt altına alınması uygulamasına başlanmış, anlaşmazlıkları giderecek ve yargı önünde ispat gücüne sahip olacak biçimde belgelerin nasıl düzenleneceği ile ilgili esaslar tespit edilmiştir. Sözleşmelerin tanziminde fıkıh, inşâ, edeb ve kitâbet ilimlerinden yararlanılmış, toplumların söz konusu muamele ile ilgili uygulamaları dikkate alınmıştır. Bu makalede konak satışı örneğinden hareketle satış sözleşmelerinde satım konusunun tanımlanması hususuna temas edilecektir.

rom early period in Islamic societies, documentation of transaction through contracts have been begun and the basics of how to write documents in the form of disagreement and having the power of proof in the judgement have been determined. In the writing of contracts benefited from sciences of fıqh, inşâ, kitâba and considered the practices of the societies concerned with their transaction. In this article, the issue of defining the property in the sales contracts will be discussed with the example of house sale.
