Şîa hakkında yapılan tanımlar göz önünde bulundurulduğunda ortaya çıkış sebebinin siyasi bir nedene dayandığı görülmektedir. Bundan dolayı diğer Sünnî mezhepler, oluşum safhasında kendilerine has sistematik bir fıkıh teşkil etmelerine karşın Şiîlerin böyle bir fıkhî mezhep sistematiğinden bahsetmek zordur. Aynı şekilde Şiî yazarların eserlerinde özellikle fıkıh alanında imamlar kanalıyla gelmeyen diğer ilmî katkılara yer vermemeleri ve hukuku sadece rivayet yoluyla açıklanan konu olarak görmeleri de Şîa fıkhının literatür bakımından oldukça geç ortaya çıkmasına sebep olmuştur. Ca‘ferî fıkhının doğuşunu ve dönemlerini ele alan bu araştırmada önce kısaca Ca‘ferîlerin imamet anlayışı üzerinde durulmuş, devamında Ca‘ferî fıkhının doğuşu, dönemleri, yöntemleri; Ahbârilik ve Usûlilik hakkında bilgiler verilmiştir. Câ’ferî fıkhının dönemleri araştırılırken bu alanda yazılmış başlıca eserler esas alınmıştır.

Given the definitions made about the Shia, it appears that the reason for its emergence is based on a political reason. Therefore, it is difficult to speak of such a system of fiqh sects, although other Sunni sects constitute their own systematic jurisprudence during the formation phase. In the same way, Shia writers did not include other scientific contributions in their works, especially in the field of fiqh, which did not come through imams, and they saw the law as a subject only described by way of narrations, which caused Shia Fiqh to appear quite late in terms of literature. In this research, which deals with the emergence and the periods of Jafari’s fiqh, firstly, the sense of Jafari imamate has been dealt with briefly, then the information about birth of Jafari’s fiqh, its periods, its methods, Ahbarilik and Usulilik has been given. The main works written in this field have been based on while the periods of Jafari’s fiqh have been searched.
