Belh fakihleri her ne kadar Hanefi mezhebine mensup olsalar da bulundukları coğrafya itibariyle bazı uygulamalarında Irak bölgesinden ayrılmışlardır. Bu çalışmada onların örf anlayışına yer verilecektir. Belh fukahası, ilk defa özel örf üzerine fıkhî hüküm bina edilebileceğini savunmuşlardır. Özel örfle, nassın tahsis, zahiru’r-rivaye’nin tashih, yine bunu zahiru’r-rivaye’ye tercih edilebileceğini uygulamalı olarak ortaya koymuşlardır. Bununla birlikte özel örfün özel hüküm ortaya koyduğunu benimseyerek farklı bir metot izlemişlerdir. Onlar hem usul hem de füru alanlarında Irak bölgesinde gerçekleştirilmiş mesailere muhalif ictihadda bulundukları, yaşadıkları bölgenin şartlarını Irak bölgesinden ayrı olarak gördükleri için yarı bağımsız bir ekol olarak görülmüştür.

Much as jurists of Balkh originally belong to Hanafi School, they separated off from them in some ways by their geography. In this work, Balkh jurists’ view of custom will be discussed. Jurists of Balkh, for the first time, argued that judgment of fiqh could be built on special custom. With special custom, they practically revealed that Nass (the explicit provision) can be restricted and zâhir al-riwâya can be amended and also special custom can be preferred to zâhir al-riwâya. However, they adopted a different method by adopting that the special custom sets out special judgement. Balkh School has been accepted as semi-independent school, because they made different ijtihad from Iraq both on usul and furu’ on cases and they accepted their region’s condition different from Iraq region.
