Türk ve ABD polis teşkilatlarının " Zor kullanma" politikalarının karşılaştırmalı olarak incelenmesi
Zor kullanma yetkisi sadece güvenlik güçlerine, görevlerini yerine getirirken, gerekmesi durumunda kullanmaları için verilmiş bir yetkidir. Vatandaşların beden bütünlüğüne zarar verip ağır sonuçlar doğurabilecek olan bu yetkinin nasıl kullanılacağı ve sınırları kanunlar tarafından belirlenir. Bu nedenle zor kullanma politikalarını belirleyen kanunlar demokratik ülkelerde çok hassas bir konudur. Bu çalışma Türk Polis Teşkilatına zor kullanma yetkisi veren politikaların bu yetkiyi nasıl formüle ettiğini incelemektedir. Bu amaçla bu çalışma; Tom McEwen 'in 1997 yılında Amerika Birleşik Devletlerindeki 96 farklı polis biriminin zor kullanma politikalarını incelediği çalışmayı temel alarak, Türk Polis Teşkilatının ve Amerika Birleşik Devletleri polis teşkilatlarının zor kullanma politikalarını karşılaştırmalı olarak incelemektedir.
A comparative analysis of "use of force" policies of the Turkish National police and the U.S. local police departments
The right to use force is only granted to law enforcement officers in cases where deemed necessary for performing their duties. The limits and exercise of this authority are regulated by laws and regulations. Therefore, laws and regulations governing use of force authority are very critical issues in democratic countries. This study examines how policies granting the right to use to Turkish National Police formulate this authority. This study comparatively analyzes the policies related to the right to use force policies of Turkish National police with U.S. police forces based on Tom McEwen's study of 1997 that examined 96 different police departments' use offorce policies in different states of the United States.
