İnsanlar sosyal varlıklar oldukları için sosyalleşme ihtiyacı duyarak yaşarlar. Sosyalleşme süreci ise, bir arada bulunmanın yanı sıra kişilerin birbirlerinin haklarına saygılı olmalarını gerekli kılar. İşte bu bir arada yaşama düşüncesi, en gelişkin teşkilat olan devlet çatısı altında toplanmak demektir. Devlet, gücünü üç önemli erk olan yasama, yürütme ve yargı erklerinde barındırır. Bu üç erkin birbirinden bağımsız hareket edebilmeleri, günümüz çağdaş toplumlarının benimsedikleri bir yoldur. Her bir erkin uygulamalarındaki bağlayıcılık; anayasaya, dolayısıyla hukuka uygunluktur. "Sivil Anayasa" oluşturmak, Türkiye'nin gündemindeki en önemli konulardan biri olmuştur. Anayasanın sivil otorite ile oluşturulması çabaları, hem TBMM'nin hem de sivil toplum örgütlerinin bir arada, en çağdaş insan hakları ve demokrasi için çabaladıkları bir süreçten geçmektedir.

Since the human beings are social entities, they live in need of socialization. The socialization process necessitates being respectful to others rights besides being together. This notion of living together means gathering under the most developed institution: state. The state preserves her power in three major ability namely the legislation, the execution and the jurisdiction. The independent execution of these three ability is a method adopted by the contemporary communities. The obligatory applications of the each ability are the convenience to constitution so to law. Preparing the "Civilian Constitution" has been one of the most important issues on Turkey's agenda. The efforts of the Great National Assembly of Turkey and the civil society for preparing the Civilian Constitution are passing through a process including struggle for the most modern human rights and democracy.
