Türk Örnekleminde Avukat Olan İle Olmayanların Adalete ve Türkiye'deki Hukuk Sistemine İlişkin Sosyal Temsilleri

Toplumda yaşamı güvenceye bağlamak, ilişkilerde denge sağlamak ve karşılıklı bir düzen oluşturmak hukuksal anlamda adaletin görevidir. Ancak, şurası da açıktır ki, hukuk kuralları her toplumda aynı etkinlik düzeyinde işletilememektedir. Bu çalışmada, hukuk sistemimizde gözlenen aksaklıklar seçilen örneklem grubu aracılığı ile incelenmiştir. Bu amaçla 15'i avukat 15'i ise avukat olmayan, herhangi bir şekilde hukuk mesleğinde çalışmayan toplam 30 kişi ile yarı yapılandırılmış görüşmeler uygulanmıştır. Katılımcıların ileri sürdükleri düşünceler, geleneksel sosyal psikolojiye eleştiri ve alternatif getiren Serge Moscovici'nin (1984) Sosyal Temsil Kuramı çerçevesinde değerlendirilmiştir. Yaptığımız görüşmeler sonucu edindiğimiz izlenimlere göre, adalet olgusuna Türk bireylerinin zihninde olumsuz nitelikler yüklenmiştir. Yapılan bu çalışmanın adalet sistemindeki eksikliklerin tespit edilmesi ve bunların giderilmesi konusunda yol gösterici olacağı düşünülmektedir.

Social Representations of Justice System Among Lawyers vs Nonlawyers in a Turkish Sample

It is the responsibility of law to provide balance in relations, to secure lives in society, and to establish a mutual order. However, it is clear that rules of law are not put into effect at the same level of efficacy in every society. In this research, problems observed in our justice system are investigated selected sample groups. Ideas expressed by the participants were evaluated with reference to Social Representation Theory of Serge Moscovici (1984) who objects and brings forward altenatives to the traditional social psychology. According to our impressions obtained via interviews, negative features are attributed to the phenomenon of justice by Turkish individuals. It is expected that the findings of this research will help us to determine the insufficiencies of our justice system and to improve upon them.
