Ayrımcılık tazminatı işveren tarafından işçiye ödenen tazminatlardan biridir. Bu tazminat, eşit davranma borcunun ihlali sonucunda ortaya çıkar. Eşit davranma borcunun kaynağı ise Anayasa m. 10 ve İş Kanunu m. 5 tir. Eşit davranma borcu aynı nitelikteki işçiler için söz konusudur.

Discrimination Compensation is one of the compensation paid by the employer to the employee. This Compensation arises the violation of the employer's "principle of equality". The principle of equality is depends on Constitution Article 10 and Turkish Labour Act Article 5. "Principle of equality" applicable to workers of the same situation.
