CEZA ADALETİ SİSTEMİNE YENİ BİR YAKLAŞIM: TAMAMLAYICI BİR SİSTEM OLARAK “ONARICI ADALET” MEKANİZMASI

Bu çalışmanın temel amacı onarıcı adalet anlayışının geleneksel ceza adaleti sistemine yeni bir yaklaşım olarak ortaya çıkışını ve bu sistemi tamamlayıcı bir disiplin olduğunu sistemler arası bir mukayese ile ortaya koymaktır. Bu çerçevede, onarıcı adaletin geçirdiği tarihsel süreç, tanımı, düşünce yapısı, uygulanan modelleri, temel ilke ve hedefleri eleştirel ve mukayeseli bir bakış açısıyla ele alınacaktır.

A NEW APPROACH TO CRIMINAL JUSTICE SYSTEM: “RESTORATIVE JUSTICE” MECHANISM AS A SUBSIDIARY SYSTEM

The main aim of this study is to reveal the emergence of restorative justice as a new approach to conventional criminal justice and a supplementary discipline for this system with a comparative intersystem. In this context, restorative justice will be discussed within a critical and comparative point of view dealing with historical process, definition, mentality, applied modals, the main principles and aims of it.
