ACCESS TO THE EU LABOUR MARKET FOR THE THIRD COUNTRY NATIONALS: THE CASE OF FREE MOVEMENT OF THE WORKERS BETWEEN TURKEY AND THE EU

Azalan nüfus ve gözle görülür işgücü açığı gibi bütün Avrupa ekonomisinietkileyen sorunlar, AB ve üye ülkeler tarafından bu sorunları çözmeye yönelik yakıngelecekte atılacak adımlar konusundaki tartışmaları gündeme getirmiştir. AB göçpolitikasının üçüncü ülkelerden gelen çalışanları cezbeden yeni araçları dikkate değerolmakla birlikte, Türk vatandaşlarının tek pazara ulaşımını kolaylaştıran girişimlerin özelolarak değerlendirilmesi gerekmektedir. Balkanları ve Ortadoğuyu dengeleyen bölgeselbir güç olarak Türkiye Cumhuriyetinin giderek artan önemi, AByi siyasi baskı altınaalmakta, Türkiyenin Avrupa ekonomisindeki yeri ve Türk işgücünün iç pazar ile sağlananözgürlükler dahilindeki yasal statüsü hakkında üye ülkeleri nihai bir karar almayazorlamaktadır. Bu makale Türk çalışanların ABdeki serbest dolaşımını düzenleyen yasalçerçeveyi ve temel ilkeleri ortaya koymayı amaçlamakta ve AB-Türkiye ilişkilerini Avrupa şgücü piyasasına kişilerin erişiminde söz konusu ortaklık hukukundan doğan hakları veTürk işçilerin bu haklar uygulanırken karşılaştığı yasal engeller bağlamındatanımlamaktadır.

ÜÇÜNCÜ ÜLKE VATANDAŞLARININ AB İŞGÜCÜ PİYASASINA ERİŞİMİ: TÜRKİYE VE AB ARASINDA İŞÇİLERİN SERBEST DOLAŞIMI ÖRNEĞİ

The decreasing demography and visible deficit of labour force raise a question ofthe future steps taken by the EU and its Member States to solve these problems affecting theeconomy of the whole Europe. Although much attention is paid to recently establishedinstruments of the EU immigration policy with the aim to attract workers from Third States,the attempts to facilitate an access to internal market by Turkish nationals should beparticularly considered. The constantly increasing role of the Republic of Turkey as aregional power stabilising the Balkans and Middle East puts the EU under politicalpressure, forcing the Member States to take a final decision on Turkey's place in theEuropean economy and the legal status of Turkish labour within freedoms offered withinthe internal Market. This paper aims to examine the legal framework and main principlesgoverning the free movement of Turkish workers in the EU. It identifies the EU-Turkishrelations from the perspective of individuals searching an access to European labourmarket with particular emphasis on their rights arising from the so called association lawand formal obstacles that Turkish workers encounter when exercising these rights.
