MAHALLE MUHTARLIĞI HUKUKSAL VE İŞLEVSEL ANALİZLER

Mahalle mekân sosyolojisi açısından statü ve sınıf farklarının biçimlendirmediği fiziki bir alandır. Mahalleler toplumun en küçük yaşam alanını ve yerel yerleşim birimini, muhtarlıklar da en alt düzeydeki siyasal hatta hukuksal alanını oluşturur. Sosyal ilişkiler açısından ise kurumsal-hukuksal-işlevsel yönü olan, bireylerin birbirleriyle iş birliği içinde bulunduğu ve etkileştiği bir topluluktur. Muhtarlık geleneği ise zaman içerisinde oluşmuş, yine hukuksal ve siyasal boyutu bulunan ve bünyesinde birçok işlevi barından, Türk sinemasında ve edebiyatında bolca işlenmiş ve hatta bunun üzerinden toplumsal yapı tartışmaları yapılmış çok önemli tarihi ve kültürel bir kurumdur. Bir süredir dünyada ve Türkiye’de dijital devrim ve internet teknolojilerinin sağladığı olanaklar hayatın tüm alanlarını etkilediği gibi toplumun kurumsal en küçük siyasal birimi olan muhtarlık kurumunu da etkilemektedir. E-devlet süreci ile beraber muhtarlıklar işlevlerinin önemli bir kısmını yavaş yavaş dijital-internet olanaklarına devretmiş olsa da bu gelenek olarak varlığını sürdürmektedir. İşte bu makalede muhtarlık geleneğini tarihsel, hukuksal ve konjonktürel değişiklere paralel tekrar sorgulanması amaçlanmaktadır. İşte bu makalede bu yeniden tanımlamanın gerekçeleri ortaya konulmaya çalışılmıştır. Makalenin ihtiyaç hissettiği veri kaynakları ise ilgili mevzuatlar, alan yazın ve saha çalışmalarından elde edilen ikincil verilerdir. Bu veriler ışığında problem “narratif” (anlatısal) olarak ortaya konulmuş, tartışılmış ve sonuçlandırılmıştır.
