Tarihsel Arka Planı Bağlamında Hegel’in Anayasa Düşüncesi

İktidarın sınırlanması bağlamında yürütülen modern devlet tartışmaları anayasa konusunu temel bir sorgulama olarak görmektedirler. Tarihsel olarak bakıldığında anayasanın neliği üzerine süregiden felsefi tartışmalar ağırlıklı ola-rak hukuki sorgulamalarla aynı zemini paylaşmaktadır. Tartışmalar genellikle kendisine nesne olarak bir “anayasal devlet” veya bir “anayasalı devlet” fikrini almaktadırlar. Felsefi bağlamda öne çıkan bir diğer yaklaşım ise devlet ve anaya-sanın aslen özdeş olduğu fikrine dayanan yaklaşımdır. Hegel’in kendi çağında Almanya’da süregiden anayasa tartışmaları ışığında söz konusu özdeşlik düşün-cesine sahip olduğu söylenebilir. Her ne kadar Hegel’in anayasa düşüncesi asli olarak “Hukuk Felsefesi’nin Prensipleri” başlıklı çalışmasında tartışılıyor ve olsa da filozofun erken dönem metinlerinden başlayarak anayasa üzerine düşüncele-rini takip etmek mümkündür. Bu çalışmada öncelikli olarak Hegel’in anayasa fikri üzerine yürüttüğü tartışmalar tarihsel bir bağlamda ele alınacak ve Hegel’in yürüttüğü anayasa tartışmasının temel anlamı üzerine bir inceleme sunulacaktır. Bu tarihsel okuma denemesi ayrıca modern devlet tartışması bağlamında belirli bir tavrı da gözler önüne sermektedir.

Hegel's Idea of the Constitution and its Historical Background

Modern state debates within the context of the restriction of power take the problem of the constitution as a fundamental issue. Historically, ongo-ing philosophical debates on the nature of the constitution predominantly share the same ground with the law theory; both based on the idea of a “consti-tutional state” or a “constitutional state”. Another approach that distinguishes itself in the philosophical context is the approach based on the idea that the state and the constitution are essentially identical. Hegel had this idea that the state and the constitution are essentially identical in light of the ongoing de-bates in Germany in his era. In this study, an examination of the origin and the context of Hegel's idea of the constitution will be presented. It will be argued that this historical approach reveals a certain process in terms of the course of the modern state debate.
