Yeni Azınlıklar” : Avrupa’nın Yeni Kavramı Azınlık Haklarının Korunmasına İlişkin Mevcut Düzenlemeler Işığında “Yeni Azınlık” Hakları

“Yeni azınlık” kavramı 2000’li yılların başında, ilk olarak Avrupa Güvenlik ve İşbirliği Teşkilatı (AGİT) metinlerinde yer almış ve ardından Avrupa Konseyi tarafından geliştirilmiştir. Kavram aynı zamanda, “azınlık” ve “göçmen” olmak üzere iki temel kavramı kapsayıcı niteliktedir. Bu bağlamda “yeni azınlıklar”, aynı zamanda “göçmen geçmişi olan yeni azınlıklar” şeklinde de ifade edilmektedir. Bu kapsamda “yeni azınlıklar”; göçmenler ve onların yeni nesillerini ve hatta mültecileri kapsamaktadır. Bu çerçevede, bu makale, ilk olarak “yeni azınlık” kavramını tanımlayıp kapsamını inceliyor, ardından Uluslararası Hukuk sisteminde Azınlık Haklarının korunmasına ilişkin mevcut düzenlemelerin, özellikle de Birleşmiş Milletler, Avrupa Konseyi ve AGİT normlarının, “yeni azınlıkları” kapsayıcı olup olmadığını ele alıyor.

New minority ": New concept of the new Europe What is the articulation of international law standards for the protection of new minorities?

The concept of « new minority » surfaced in the 2000s and was initially analyzed by the Organization for Security and Co-operation in Europe and the Council of Europe. It is a new concept hinging on two notions, minorities and immigrant, which are the factors driving the emergence of this new category: the « new minority from immigrant backgrounds ». In this context firstly, this article will try to clarify the concept of “new minority” especially its linkage between the notion of “immigrant” and “minority”. Secondly, this study will focus on the question of the protection of the rights of “new minorities” and in order to achieve that, we will examine international norms that include the rights of minorities and will analyze the possibility to extend a national minority protection system to “new minorities”.
