PATENTİN İNHİSARÎLİK UNSURUNUN İNGİLTERE’DE ORTAYA ÇIKIŞINDA JACOPO ACONCIO’NUN ROLÜ

Bu makalede, bir Reformasyon ve Rönesans insanı olan Trentolu Jacopo Aconcio’nun patentin “inhisarîlik” unsurunun İngiltere’de ortaya çıkışında oynadığı rol üzerinde durulmaktadır. Bu amaçla önce Aconcio’nun hayatı üzerinde kısaca durulmuştur. 1557’de İsviçre’ye geçişine kadar olan hayatı hakkında çok az şey bilinmektedir. Reform yanlısı görüşleri nedeniyle hayatının son yıllarında İtalya’yı terk ederek Basel ve Zürih’e yerleşmesi, orada Marian sürgünleri ile tanışması, Birinci Elizabeth’in tahta çıkmasından sonra sırasıyla Strazburg’a, oradan da Sir Cecil’in daveti ile Londra’ya geçişi anlatılmaktadır. Bu dönemde kaleme aldığı önemle eserlere kısaca değinilmektedir. Bir mühendis olarak Aconcio’nun İngiltere’ye varır varmaz Kraliçe’ye yaptığı yazılı başvuru üzerinden ve Holdsworth, Hulme ve White Jr.’ın konuya dair görüşlerinden hareketle Seaborn Davies ile Jeremy Phillips arasında Aconcio’nun İngiltere’de patentin inhisarîlik unsurunun oluşumundaki rolüne dair tartışmalar üzerinde ayrıntılı olarak durulacaktır. Çalışma, tarihsel yaklaşımdan yararlanmak suretiyle hem 16. yy.’a dair meselelerin değerlendirilmesinde hem de o döneme ait belli kavramların anlaşılmasında ve kullanılmasında dikkat edilmesi gereken önemli hususları içeren bir bölüm ile sona ermektedir.
