LOCATIO CONDUCTIO OPERIS’TE İŞ SAHİBİNİN MALZEMEYİ TEMİN ETME BORCU

Roma hukukundaki kökenleri tartışmalı olan locatio conductio, Gaius’un Institutiones’inde rızai sözleşmeler kapsamında değerlendirilir. Eser sözleşmelerinde yüklenici, iş sahibinin vereceği ücret karşılığında ve iş sahibi tarafından verilen bir malzeme ile bir sonucu, eseri meydana getirmeyi ve teslim etmeyi üstlenir. Roma döneminde, eser sözleşmesinin kurulması için malzemenin iş sahibi tarafından verilmesi şarttı. Günümüzde yüklenici veya iş sahibi tarafından temin edilmesi herhangi bir önem taşımamaktadır.

The Duty of Conductor to Supply Material in Locatio Conductio Operis

Although not much is known about the origins of locatio conductio, it is classified as one of the consensual contracts by Gaius’ Institutes. In locatio conductio operis, conductor is obliged to complete and deliver the work with the materials given by the locator in return for the price to be paid. In Roman law, it was the duty of locator to supply the material. It was a sine qua non element to establish locatio conductio operis. In modern laws, it is not an essential element whether the material is supplied by locator or conductor. Contract of work is a contract, in which locator.
