Belçika Ceza Hukukunda Çalışma Cezası

Ülkelerin ceza politikaları, insan haklarına verilen önem ve kıymete göre yıllar içerisinde farklı aşamalardan geçmiştir. Özellikle toplum içerisinde infazı yapılan yaptırımlar, çeşit ve içerik olarak bu gelişimden en çok etkilenmiş olan alandır. Çalışma cezası son yıllarda en çok rağbet gören yaptırım türlerinden biridir. Herkese hitap edebilmesi ve her ceza siyasetine uygun olabilmesi (bukalemun yapısı) bunda en önemli nedendir. Bu çalışmamızda toplum içerisinde infaz edilen yaptırımlardan biri olan çalışma cezasını Belçika ceza hukuku çerçevesinde incelemeye çalışacağız. Belçika, sekiz yıllık “kamu yararına çalışma ” uygulamasının ardından, çalışma cezası ile ilgili düzenlemeleri ceza kanununa ayrı bir bölüm olarak eklemiştir. Tarihsel gelişim, ilk uygulama şekli, yasal düzenlemeler, çalışma cezası kapsamında tekerrür ve teşebbüs ile uygulamanın istatistiklere yansıması da değerlendirilecektir

WORK PENALTY IN THE BELGIAN CRIMINAL LAW

Penal policies of countries, have gone through different stages in proportion to the importance and value that is given to human rights in years. Especially, sanctions which are implemented in the community had been affected mostly from this development by variety and content. Work penalty is one of the most- preferred sanction types in recent years. The compatibility to everyone and suitability to each penal policy (chameleon structure) is the most important reason. In our study,we will try to examine work penalty which is one of the sanction implemented within the community in accordance with the Belgian criminal law. Belgium has added work penalty as a separate chapter in the penal code after an eight year practice of “community service”’. Also, historical improvement,type of fi rst practice,legal arrangements, reoffending and attempt in the scope of work penalty and the refl exion of parctice to statistics will be evaluated
