Bu çalışmamızda, Türk Ceza Kanunu’nun “Kişilere Karşı Suçlar” başlıklı ikinci kısım, onuncu bölümde “Malvarlığına Karşı Suçlar” bölümünde düzenlenen hırsızlık suçu hakkındaki maddeler esas alınmak suretiyle açıklamalara yer verilmiştir. Mülkiyet hakkı, menkul mal gibi hırsızlık suçlarında korunması gereken hukuki menfaatler ile suçun unsurları hakkında, Yargıtay kararları dikkate alınmak suretiyle görüşlerimize yer verdik.

n this study theft crimes which is regulated in second chapter, titled as “offences against individuals”, at the 10th section under the title of crimes against private property of Turkish Criminal Law, have been discussed on the basis of articles. Our opinions about, legal benefits that must be protected in the theft crimes such as ownership right, personal property and elements of the crime have been expressed taking account of court of appeal’s decisions.
