BİRLEŞMİŞ MİLLETLER YOLSUZLUKLA MÜCADELE SÖZLEŞMESİ VE SÖZLEŞMENİN UYGULANMASI YÖNÜNDEKİ ÇABALAR

Bu makalede 2003 yılında kabul edilen ve 2005 yılında yürürlüğe giren Birleşmiş Milletler Yolsuzlukla Mücadele Sözleşmesi (BMYMS) ayrıntılı olarak incelenecektir. Birleşmiş Milletlerin yolsuzlukla mücadeleye ilişkin önemli çalışmaları vardır; ancak bunlar arasında tarafları bakımından bağlayıcı bir metin olması itibariyle BMYMS'nin yeri ayrıdır. Sözleşmede öncelikle taraf devletlerin yolsuzlukların önlenmesi için almaları gereken tedbirler ayrıntıları ile düzenlenmiştir. Daha sonra taraf devletlerce suç haline getirmeleri gereken yolsuzluk fiilleri ve suç haline getirilmesi irdelenecek yolsuzluk fiilleri ayrıntılı olarak tanımlanmıştır. Yolsuzlukların yargılanması için en önemli konulardan biri olan uluslararası adli işbirliği çerçevesinde özellikle suçluların iadesi ve karşılıklı adli yardım düzenlenmiştir. Varlıkların geri alınması ise Sözleşmenin bir ilkesi olarak kabul edilmiştir. Sözleşmenin uygulanmasına ilişkin hükümler ise çok genel ifadelerle düzenlenmiş; uygulanmanın sağlanması için yapılacak ayrıntılı düzenlemeler Taraflar Konferansına bırakılmıştır. Sözleşme çerçevesinde oluşturulan Taraflar Konferansı ile özellikle uygulanma yönünde önemli adımlar atılmıştır.

UNITED NATIONS CONVENTION AGAINST CORRUPTION AND EFFORTS REGARDING ITS IMPLEMENTATION

In this article the United Nations Convention Against Corruption (UNCAC) that was adopted in 2003 and entered into force in 2005 will be scrutinized in detail. The United Nations has studied a lot on combat corruption to provide many soft law instruments. However, as a binding instrument the Convention is especially important for the international community. First of all, the preventive measures regarding corruption have been regulated in the Convention. Then the requirement of criminalization of the corruption acts has been regulated in two forms; the corruption acts that state parties have to criminalize and the corruption acts that the parties will consider to criminalize. As the prosecution is crucial to combat corruption under the chapter on international cooperation, two other topics namely the mutual assistance and extradition have been regulated. The asset recovery was regarded as a principle by the Convention itself. The implementation provisions of the Convention are very general and the detailed regulations to provide compliance have been left to the Conference of the Parties. Since the establishment of the Conference of the Parties major steps have been taken towards the implementation of the Convention.
