ULUSLARARASI DENİZ HUKUKUNA HAKİM OLAN İLKELER KAPSAMINDA KİTLE İMHA SİLAHLARININ YAYILMASINI ENGELLEMEYE YÖNELİK TEDBİRLERİN DEĞERLENDİRİLMESİ

Uluslararası deniz hukuku üzerine inşa edildiği geleneksel ilkeler kapsamında gelişmiş ve bugünkü halini almıştır. Devletlerin üzerinde egemenlik kurduğu veya egemen haklarını kullandığı deniz alanları haricinde tüm devletlerin ve uluslarının menfaatinin bulunduğu açık denizlerin kaos ortamına dönüşmemesi için bu önemli ilkelerin korunması önem arz etmektedir. Dünya küresel ticaretinin büyük çoğunluğunun denizler vasıtasıyla gerçekleşmesi göz önüne alındığında; denizlerde meydana gelebilecek bir güvenlik sorununun tedarik zincirini bozacağı ve insanlığa önemli ölçüde zarar verebileceği anlaşılmaktadır. Bu nedenle uluslararası deniz hukuku belirli deniz güvenliği tehditlerini ve bunların bastırılması için gereken tedbirleri içermektedir. Ancak dünyada deniz güvenliği tehditleri artmakta ve ihtiyaçlar değişmektedir. Yakın dönemde ortaya çıkan kitle imha silahlarının yayılması tehdidi bunun bir örneğidir. Kitle imha silahlarının yayılmasının denizlerde engellenmesi için geliştirilen tedbirler B.M Güvenlik Konseyi Kararları, Kitle İmha Silahlarının Yayılmasına Karşı Güvenlik İnisiyatifi ve buna dayanarak ortaya çıkan karşılıklı anlaşmalar, 1988 SUA Sözleşmesi ve 2005 Protokolü gibi uluslararası hukuk kaynaklarında düzenlenmektedir. Bu çalışma kapsamında uluslararası hukukta bu güncel tehdide karşı geliştirilen tedbirlerin etkililiği ve hukuka uygunluğu deniz hukukunun geleneksel ilkelerinin ışığı altında tartışılmaktadır.
