The European Union, through its legal frame for the protection of personal data, led the member states to establish protection mechanisms accordingly. The purpose of the establishment of these institutions, established by the member states within this framework and called data protection and supervisory authorities, is to prevent the personal data to be stored and processed against its aim and the laws. In this article, the "independence" characteristic of those national institutions in the EU member states, which is required pursuant to the Directive 95/46/EC issued by the Union and EU Charter of Fundamental Rights, will be questioned. It is planned that the study sheds light on the assurances of independence that the institution to be established in Turkey pursuant to the membership negotiations with the EU must have as well as on those that the institutions in member states have.
