AİHK’NUN 15.MADDESİ VE AİHM’NİN BU BAĞLAMDA OYNADIĞI ROL

Makalede AİHK’nun 15.maddesi ışığında AİHM’nin insan haklarının korunmasında oynadığı rol ele alınmaktadır. Bu bağlamda makalede Konvansiyon tarafı devletlere 15.madde muvacehesinde bırakılan takdir alanının (“margin of appreciation”) kapsamı, Konvansiyon tarafı devletlere olağanüstü hale yol açan tehlikelerle mücadele için tanınan takdir alanının kapsamı sorularının cevabı aranmaktadır. Bu soruların cevaplandırılması için makale üç bölüm olarak düzenlenmiştir. İlk bölümde AİHK’nun 15.maddesi çerçevesinde söz konusu edilen takdir alanı güncel AİHM kararları ışığında değerlendirilmekte; ikinci bölümde olağanüstü durumlarda takdir alanının genişletilmesinin AİHK’nun 15.madde gerekliliklerine bağlı kriterler ışığında mümkün olduğu ortaya konulmaktadır. Makalenin üçüncü bölümünde ise demokrasiyi tehlikeye sokan olağanüstü hal durumunda AİHM’nin rolü ele alınmaktadır.

ARTICLE 15 OF THE EUROPEAN CONVENTION OF HUMAN RIGHTS AND THE ROLE OF THE EUROPEAN COURT OF HUMAN RIGHTS WITH REGARD TO ARTICLE 15

The article discusses the role played by the ECHR in the protection of human rights with regard to Article 15 of the European Convention of Human Rights. In this context, the article analyses the scope of the "margin of appreciation" granted to the Contracting States under Article 15 and the discretion left to the Contracting States in times of emergency. The article is organized in three sections. In the first part, it evaluates the jurisprudence of the European Court of Human Rights specifically with regard to Article 15 of the European Convention on Human Rights In the second part, it assesses the flexibility which the Contracting States have in extraordinary situations in the light of Article 15. In the third part, it discusses the role of the ECHR in the state of emergency that endangers democracy.
