DENİZ YATAĞI UYUŞMAZLIKLARI DAİRESİ’NİN DANIŞMA GÖRÜŞÜ ÇERÇEVESİNDE ULUSLARARASI DERİN DENİZ YATAĞI MADENCİLİĞİNDE SPONSOR DEVLETİN SORUMLULUĞU
2010’da Nauru Cumhuriyeti’nin önerisi üzerine Uluslararası Derin Deniz Yatağı Otoritesi, Uluslararası Deniz Hukuku Mahkemesi’nin özel bir dairesi olan Deniz Yatağı Uyuşmazlıkları Dairesi’nden “sponsor devletlerin bölgedeki madencilik faaliyetlerine ilişkin yükümlülük ve sorumluluklarına” dâir danışma görüşü istemiştir. 11 Şubat 2011’de kabul edilen görüşte, sponsor devletlerin sözleşmeden doğan doğrudan yükümlülük ve sorumluluklarının yanında, sponsor oldukları gerçek veya tüzel kişilerin bölgedeki faaliyetlerinden kaynaklanan dolaylı yükümlülük ve sorumluluklarına yer verilmiştir. Görüşte, bölgenin insanlığın ortak mirası olması çerçevesinde, sponsor devletlerin özen yükümlülüğü vurgulanmış ve sponsor devletlere bölgenin faaliyetlerden doğabilecek çevresel zararlardan korunması amacıyla kapsamlı yükümlülükler getirilmiştir.
