ULUSLARARASI HUKUK DÜŞÜNCESİNDE KLÂSİK ÖĞRETİNİN KURULUŞU: HUGO GROTİUS VE POSTGROTİEN YAZARLAR SAMUEL VON PUFENDORF, RİCHARD ZOUCHE, CORNELİUS VAN BYNKERSHOEK VE SAMUEL RACHEL’E İLİŞKİN İNCELEME VE DEĞERLENDİRME

Bu makalede, XVII’nci yüzyılda, “uluslararası hukukun klâsik öğretisi” oluşurken, görüşlerin doğal hukukçu bir anlayıştan, pozitif hukuk anlayışına doğru evrilmesindeki seyir açıklandı. Makalede, anılan yüzyılda, Avrupa’daki ulusal ve uluslararası siyasal ilişkilerin, oluşmakta olan hukuk kurallarının içeriğine yapısal bakımdan nasıl etki ettiği gösterildikten sonra; felsefedeki atılımların disiplinin metodolojisine ve öğretinin üzerine kurulduğu ilkin rasyonalizme, sonrasında pozitivizme zemin hazırladığı ileri sürülmektedir. Bu çerçevede, çağdaş modern evrensel uluslararası hukuk öğretisinin, XVII’nci yüzyıldaki kökenlerinin araştırılması hedeflendi. Bu hedef doğrultusunda çalışma konusuna dâhil yazarlar Hugo Grotius, Samuel von Pufendorf, Richard Zouche, Cornelius van Bynkershoek ve Samuel Rachel’dir.

On this article we tried to explain the convertion of natural law views into a positive law views, during the establishment of the international law classical doctrine on the XVII. century. In the content of this article, after having shown how the national and international political relations in Europe, durig the mentioned century, have influenced the content of the establishment of law requlations and how the progress in philosophy have influenced the methodology of this discipline and the doctrine found primerily on rationalism and later on in positivism. In this context we target to investigate the sourcess of the contemprary modern universal international law doctrine as to the XVII. century. Based to this aim we examined the following writers views: Hugo Grotius, Sammuel von Pufendorf, Richart Zouche, Cornelius van Bynkershoek and Samuel Rachel.
