Adalet ve Sosyal Düzen Arayışında Özgürlük ve Eşitlik Çatışması

Bu makalede adalet, sosyal düzen ve insan doğası kavramlarının modern siyaset felsefesinin temel konuları içinde yer aldığı düşüncesinden hareketle, esas olarak adalet, sosyal düzen ve özgürlük ilişkisi çerçevesinde genel bir değerlendirme yapılmaktadır. Mülkiyet ve hukuk arasındaki ilişkinin anılan kavramlar bağlamında oluşturulan teorik çerçeveye göre şekilleneceği ileri sürülmektedir. Adalet nedir, sosyal düzen nedir, insan doğası nedir? Bu sorulara yönelik cevaplar farklı teorik tarzların ortaya çıkmasını sağlamıştır. Adalet ve sosyal düzen fikri bir arada değerlendirildiğinden, adaletin mahiyeti ve tatbiki sosyal düzen anlayışına göre oluşmaktadır. Bu bakımdan, adalet sosyal bir içeriğe sahiptir ve sosyal düzen ve özgürlük anlayışına göre anlam kazanmaktadır.

Conflict of Liberty and Equality in Finding Justice and Social Order

This paper argues that the notions of justice, social order and human nature are essential topics of modern political philosophy. The connection between justice and social order, and liberty brings about a discussion on the right of property and law. Therefore, the main aim of this paper is to review the notions of justice, social order and liberty and to clarify the subject matter in terms of classical liberal perspective. Indeed, Social-political and moral evaluations are based on the concepts of justice. In this sense, social order and human nature are the main theme of political philosophy. What is justice, what is social order, what is human nature? The answers to the question shave provided the emergence of various theoretical perspectives. Since the idea of justice and social order is often taken in tandem and evaluated together, the question of what justice is and how it can be ensured necessarily requires the definition of social order. In this respect, justice has a social content and it is related to social order and liberty.
